Washington — The Department of Transportation has increased civil penalty amounts for violations to adjust for inflation, effective March 21.
The increase is 1.06222% for DOT agencies, including the Federal Motor Carrier Safety Administration, according to a final rule published in the March 21 Federal Register.
The adjustments for FMCSA penalties are listed in Appendices A and B to 49 CFR part 386. A chart of the affected penalties is available in Section D of the final rule.
Under the Federal Civil Penalties Inflation Adjustment Act of 1990, DOT is required to adjust civil penalty levels for inflation each year. DOT determines yearly adjustment rates via the Consumer Price Index for All Urban Consumers.
